Saber Training Academy Waiver

ASSUMPTION OF RISK • RELEASE OF LIABILITY • INDEMNITY • PHOTO/VIDEO RELEASE

This Assumption of Risk, Release of Liability, Indemnity, and Photo/Video Release (“Waiver”) is entered into by the undersigned participant (“Participant,” “I,” “me,” “my”), in favor of the following Released Parties (defined below).

1) Definitions (who is covered)

For purposes of this Agreement, the “Released Parties” include, individually and collectively:

* Light Sword Martial Arts PMA (the “PMA”), its directors, officers, members, volunteers, staff, and agents;

* Any licensed instructor teaching, assisting, coaching, supervising, or hosting Light Sword Martial Arts training, whether acting as an individual and/or through a separate business entity (LLC, corporation, partnership, sole proprietorship), including that entity’s owners, officers, employees, contractors, agents, and volunteers;

* Any host location / facility / venue, including owners, landlords, property managers, and their employees/agents;

* Any affiliated organizations, sponsors, event organizers, and participants acting in a support or supervision role.

2) Activities covered

This Agreement applies to all participation in Light Sword Martial Arts–related activities, including but not limited to: classes, sparring, drills, conditioning, demonstrations, weapons handling (training weapons), choreography, travel to/from events, open gym sessions, seminars, workshops, tournaments, testing, online or in-person instruction, and any related use of equipment and facilities (collectively, “Activities”).

3) Assumption of risk

I understand and acknowledge that the Activities involve inherent and significant risks, including but not limited to:

* slips, trips, falls; collisions with people or objects;

* strains, sprains, bruises, cuts, fractures, dislocations;

* eye injury, concussion, head/neck/back injury;

* aggravation of pre-existing conditions;

* serious injury, permanent disability, paralysis, or death;

* property loss or damage.

I voluntarily choose to participate and assume all risks, whether known or unknown, foreseeable or unforeseeable, inherent or otherwise, to the fullest extent allowed by law.

4) Participant health statement

I represent that I am physically and mentally able to participate safely. I understand I should consult a physician if I have any doubts about my fitness to participate. I agree to stop participating immediately if I feel pain, dizziness, faintness, unusual shortness of breath, or any condition that may indicate risk.

5) Release of liability (including ordinary negligence)

In consideration for being allowed to participate, I hereby release, waive, and discharge the Released Parties from any and all claims, demands, causes of action, damages, injuries, losses, or expenses of any kind arising out of or related to my participation in the Activities, including claims based on ordinary negligence of any Released Party, to the fullest extent permitted by law.

This release includes (without limitation) claims for personal injury, wrongful death, emotional distress, property damage, theft, and loss of use.

Important: This Agreement does not release claims that cannot be released under applicable law (for example, certain claims involving gross negligence, willful misconduct, or fraud, if applicable in your jurisdiction).

6) Indemnity / hold harmless / defense

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to:

* my participation in the Activities;

* my acts or omissions (including negligent acts);

* my breach of this Agreement; and/or

* claims brought by or on behalf of others related to my participation (including guests or family members).

7) Rules, safety, and equipment

I agree to follow all safety rules and instructions, including protective gear requirements (e.g., eye protection, helmets, gloves, pads) when directed. I acknowledge that the PMA/instructors may deny participation to anyone they believe poses a safety risk.

8) Medical emergency authorization

If I am injured or become ill, I authorize the Released Parties to arrange emergency care and transportation as they deem appropriate. I understand I am responsible for all costs of medical care and transport.

9) Photo / video / audio release (media release)

I grant the Released Parties the right to photograph, video record, and/or audio record me during Activities and to use my likeness, image, voice, name, and/or biographical information in any medium (including websites, social media, marketing, instructional materials, and promotional content) for lawful purposes.

I understand I will receive no compensation.

I waive any right to inspect or approve the finished content.

I release the Released Parties from any claims related to the use of such media, including claims for invasion of privacy, right of publicity, defamation, or misappropriation, to the fullest extent permitted by law.

10) Intellectual property / recording by Participant

To protect training content and member privacy, I agree that I will not record, reproduce, distribute, or publicly post proprietary class content, lesson plans, choreography, curriculum materials, or private member interactions without prior written permission from the applicable instructor/PMA/host.

11) Dispute resolution (optional arbitration language)

Any dispute arising out of or relating to this Agreement or the Activities shall first be addressed in good faith between the parties. If not resolved, the parties agree to pursue resolution through mediation, and if still unresolved, binding arbitration, unless prohibited by applicable law. Judgment on an arbitration award may be entered in any court with jurisdiction.

12) Venue / governing law

This Agreement shall be governed by the laws of the state where the Activity occurs, without regard to conflict-of-law rules. Any court proceedings permitted under this Agreement shall be brought in the county/state where the Activity occurs, unless otherwise required by law.

13) Severability and full agreement

If any provision is found unenforceable, the remaining provisions will remain in full force. This Agreement is the entire agreement regarding these topics and supersedes prior oral or written statements.

14) Acknowledgment

By clicking “I Agree,” “Accept,” “Join,” “Enroll,” “Register,” “Purchase,” “Book,” or otherwise accessing, attending, or participating in any Light Sword Martial Arts–related Activities, I acknowledge and agree that:

1. I have read and understood this Waiver of Assumption of Risk, Release of Liability, Indemnity, and Photo/Video Release in its entirety.

2. I agree to be legally bound by its terms as if I had signed it in ink.

3. I understand this waiver includes a release of claims, including claims based on ordinary negligence of the Released Parties, to the fullest extent permitted by law.

4. I agree that this electronic acceptance is a valid and enforceable electronic signature under applicable law (including the ESIGN Act and similar state laws).

5. If I am agreeing on behalf of a minor, I represent that I am the minor’s parent or legal guardian and I consent to the minor’s participation and agree to all terms on behalf of myself and the minor.
